Tort law expert Professor Stephen Sugarman weighs in on the administration’s proposal to limit medical malpractice awards for pain and suffering in a June 5 Los Angeles Times article. While President Bush and Senate Majority Leader Bill Frist have proposed a limit of $250,000 on what victims of medical malpractice can be awarded, Sugarman looks to Europe for a model of how to better address the medical malpractice insurance crisis. He suggests a pain-and-suffering award cap of $400,000 along with a rule that defendants have to pay victims’ legal expenses.
