This session explores the principles governing copyright protection and frames the key questions—copyright subsistence, limiting doctrines, infringement analysis, fair use, and remedies—that arise in copyright litigation. It begins with a tutorial led by leading scholars and treatise writers, followed by a series of simulations of actual and hypothetical infringement and fair use cases. It is an essential introduction for judges who have never studied or practiced copyright law and a good refresher for those who have.
