Topics in Civil Procedure will introduce LLM students to core concepts in American civil procedure. It will explore what court or courts have the power to hear a particular dispute, and what options parties have in choosing between or among them. It will cover personal jurisdiction, subject-matter jurisdiction (particularly of the federal courts), venue, change of venue, and forum non conveniens, with an emphasis on how these doctrines may affect international parties involved in American legal disputes. It will also cover selected Federal Rules of Civil Procedure relating to the disposition of disputes before a trial. Finally, it will explore the problem posed by Erie Railroad v. Tompkins: when a federal court is exercising its jurisdiction to adjudicate a claim based on state substantive law, to what extent should the federal court also follow state procedural law?
Prerequisites:
This course will assume all enrolled students are already familiar with all cases assigned in Fundamentals of American Law.
Although Fundamentals of American law is not a prerequisite, LLM students who received a waiver of the Fundamentals course may potentially need to do weekly supplemental reading to catch up on material they missed in Fundamentals.
This course satisfies the Constitutional Law Requirement.
