Award-Winning Effort on Antitrust

An article by Stephen Maurer and his former Berkeley Law colleague, the late Suzanne Scotchmer, won an American Antitrust Institute Jerry S. Cohen Award. “The Essential Facilities Doctrine: The Lost Message of Terminal Railroad” was named 2014’s best article on Section 2 of the landmark Sherman Antitrust Act. It touts the doctrine’s role in boosting economic synergies through sharing, and says that without it such synergies would be jeopardized—in part by arrangements that undermine competition.
