This seminar incorporates and builds on basic lawyering skills students have already learned and perhaps implemented in practice. It is designed for those who have completed a criminal field placement and is offered in conjunction with UC Hastings College of the Law.
Through discussion and simulations, we will explore several complex lawyering tasks (e.g., jury selection, use of experts at trial) as well as more familiar tasks from a more advanced perspective (e.g. case theory, interviewing "problem" witnesses). The seminar will rely partly on guest speakers, including academics and practitioners. Readings will include case law, rules, and practice guides, as well as some more theoretical and interdisciplinary material. In addition, as time permits, students will conduct simulations for review and analysis in class. Students may be required to record one or more additional simulations outside class hours.
