The course will examine criminal investigations and the constitutional and statutory law relating to police officers/government agents and lawyers. Topics include the role of prosecution and defense counsel, search and seizure, police interrogation, the exclusionary rule, and assistance of counsel.

We will be using the same course reader as in the 4 unit course taught by Professor Weisselberg, but in light of the difference in credits, there will be less reading and a few select topics will be addressed in less depth. We will cover all of the basic constitutional law and practice points and also link our studies to topics of current interest, like New York's stop-and-frisk practices, recent revelations about government wiretapping, and police searches of smartphones. Part of the final grade will be based on class participation and we will make regular use of class exercises with students in role.

Shawn Halbert graduated from Harvard Law School in 1995 and then worked at Heller Ehrman as a litigation associate with a practice including white collar criminal defense. She has been an attorney with the Federal Public Defender’s Office (N.D.Cal.) since 1999 (and will leave that office the end of this year). Her work as a public defender has involved representing clients in evidentiary hearings, trials, sentencing hearings and appellate arguments (Ninth Circuit) in cases alleging a wide range of federal offenses, including RICO prosecutions with death penalty allegations.
