Real estate sales and lending were at ground zero in the Great Recession and will be at the heart of the ongoing recovery. While some kinds of real estate transactional work for attorneys declined during a recession, many other types of work -- such as loan workouts, short sales, escrow, title insurance, fraud and contract litigation, as well as foreclosures -- abound in good and bad times. This course, offered at BerkeleyLaw since the mid 1980s and brought current to reflect recent lessons and realities, focuses on land sales from both transactional and litigation perspectives. It expands on the L1 Property course and considers, conceptually and practically, such critical concepts as broker duties and regulation, land sale contracts, options, commercial leasing, priority conflicts, development and construction issues, escrows, title insurance, remedies and an introduction to real estate-secure lending, trust deeds, and foreclosures. 2Ls and 3Ls, graduate students in Business, Urban Planning and other real estate-related disciplines, as well as visiting foreign scholars, are all welcome.
