This course examines the differential treatment of women and men in five subject matter areas from both a theoretical and legal perspective. The first, constitutional law, focuses on claims of unconstitutional discrimination based on sex and gender under the equal protection and due process clauses of the federal (and some state) constitutions. The second area is a broad look at differential treatment of mothers and fathers, and married spouses (both same-sex and opposite sex) in family law cases, including marriage, divorce, child custody, and family planning involving both child bearing and child rearing as well as assisted reproduction, contraception, and abortion. The third area deals with the public and private workplaces involved in sex discrimination in employment and examines hiring and firing, wage discrimination, workers' rights, and employers' obligations. Coverage in this area is limited to federal law (primarily Title VII of the Civil Rights Act of 1964, the Equal Pay Act of 1963, and case law interpreting and applying those federal statutes), but it does not include state employment law. The fourth area is education law. Coverage here includes both public and private schools, coeducational and single sex schools (and classes) and Title IX, dealing both with access to equal schooling both in the classroom and in athletics at all levels. The final area examined here is that of the criminal law. Again, the coverage focuses on cases both under the constitution and federal law dealing with rape, prostitution, domestic violence, and a look at the gendered natute of prison guards as an occupation.
There is obvious overlapping between the subjects covered in employment discrimination and in this course, but the theoretical perspectives are sufficiently distinct in this course so that students who have taken employment discrimination can also receive credit for this course. There are no prerequisites.
