“Law and Modern Social Thought” surveys leading attempts to construct social theories of law and to use legal materials for the construction of systematic social theory. The seminar focuses on an influential canon of writing from the mid-eighteenth century to the early twentieth century. Following an initial discussion of 18th-century programs for comprehensive law reform, and the characteristic political and methodological challenges these generated, we turn to the major writings of Maine, Marx, Durkheim and Weber. In considering these works, a large number of themes and controversies are considered. Particular attention is devoted to their rival attempts to characterize what was distinctive about the legal order of “modern” western societies, and to explain the social foundations of liberal theories of legal equality, the rule of law and modern rights theory.
