This is a course that is intended to highlight the principal ethics issues facing civil and criminal litigators, highlighting both shared elements and important differences between the ethical regimes in civil and criminal cases. We will look at duties to the client, to the court, to third parties, and to the legal system. We will contrast the roles of lawyers in private civil litigation with those who do criminal defense or prosecution. Among the topics included are: attorney client privilege, duty of confidentiality, duty of loyalty, duty of competence, fact investigation, evidence preservation, frivolous claims, malicious prosecution and abuse of process, negotiation and settlement, relationships with opposing parties and third parties, witness preparation, argument, duties of candor to the court; conflict of interest, and more.
This course satisfies the Professional Responsibility Requirement.
