This seminar is intended to acquaint students with some of the main currents in contemporary political philosophy with an eye toward their implications for normative analysis of law and legal institutions. The focus will be on theories of justice and theories of democracy, but we will also discuss the concepts of freedom, equality, and rights in our exploration of justice and democracy. Some of the questions we will pursue include: How do contemporary theories of distributive justice attempt to reconcile the values of freedom and equality? What is the relationship between distributive justice and the "politics of recognition"? What does equality across racial, gender, and religious differences require? What is the relationship between democracy and equality? Why should we accept majority decisions with which we disagree? Is judicial review compatible with democracy?
This course will fulfill the new JSP requirement for a foundation seminar in philosophy or theory. The course is open to JSP, JD, LLM, JSD, and PhD students from other departments on campus.
