This course will offer students an opportunity to acquire the knowledge and skills that they will need in order to effectively participate in a mediation process. Mediation theory, applicable law, and related ethical considerations and public policy concerns will be among the many subjects covered during this course. The instructor often employs experiential learning techniques and opportunities will abound for practical skills development in a safe and supportive learning environment. The course is intended for students interested in mediation as a career as well as for the far greater number of students who will provide legal representation for clients involved in mediation processes or who may themselves be party participants in mediated conflicts. All students will be able to gain that clear and deep understanding of the mediation process that is so necessary for anyone who hopes to effectively participate in mediated conflict resolution efforts. Many students who have taken Mediation in the past have reported that the improvement in their communication and other interpersonal skills gained during this course has been put to good use in a large variety of professional and personal situations.
LLM students are very welcome to take this course. All students with an interest in the subject matter, with or without prior mediation or negotiation experience or education, are encouraged to enroll.

INSTRUCTOR BIOGRAPHY: A former civil litigator with more than thirty years of experience handling complex legal disputes, Carol Marshall is now a full-time neutral and conflict resolution specialist with offices in San Francisco and Mill Valley, California. She has represented parties or conducted mediation, binding arbitration or facilitation processes in many hundreds of matters involving a wide variety of issues related to business and commercial dealings, employment relationships, environmental contamination, trade secret violations, real estate disputes, partnership dissolutions, insurance coverage disagreements, personal injury claims, ADA access problems, intellectual property infringement, and other subject matter areas. She has also designed dispute resolution programs for some of her corporate clients.
Ms. Marshall received a J.D. in May 1978 from UCLA Law School and became a member of the California bar in November of the same year. She holds a graduate degree (M.A.) from NYU and an undergraduate degree (B.A.) from St. John's University in New York. In addition to her private conflict resolution practice, Ms. Marshall teaches mediation and other conflict resolution courses at several San Francisco Bay Area schools including UC Berkeley Law School, Santa Clara Law School and Mills College (in the Public Policy Graduate Program).
