Unlike Law 231 (basic Criminal Procedure, a prerequisite for this
course),this course is about the phases of the criminal process that
occur after arrest. As the gamut of pretrial and post-trial
proceedings are studied, special attention will be paid to emerging
problems in some adjudicatory functions in the justice system: e.g.
diversion, coercive plea bargaining, discriminatory jury selection,
sexual predator proceedings, use of intrusive technology to build a
case, as well as selective topics related to capital punishment. While the course will include study of post-conviction relief and capital case adjudication, it will not go into those subjects in the depth other courses provide.
Professor Coleman attended Yale Law School in 1967-68 and Harvard Law School from 1969-71, where he received his law degree. In 1974, after two years at the Earl Warren Legal Institute at Berkeley, Coleman joined the staff of the Contra Costa County Office of Public Defender. During his career as a public defender Professor Coleman tried scores of felony cases, was lead counsel in seven capital cases and argued cases in the Court of Appeal, the California Supreme Court and the Ninth Circuit. Professor Coleman was appointed Public Defender in 1999 and retired from that position in 2009. Professor Coleman served as an adjunct professor at Boalt from 1981 through 2004. He taught criminal procedure from 1986 through 2004 and evidence from 1997 through 2004. Professor Coleman is a State Bar Certified Specialist in Criminal Law and served for many years on the Judicial Council's Criminal Law Advisory Committee.
