This Course will focus on the dynamics of large multi-party, multi-forum civil cases, the Challenges they present to implementing the ideal of "just, speedy, and inexpensive" adjudication and resolution, and how the key "players" in complex civil litigation (judges, plaintiffs' counsel, defense counsel, and corporate decision-makers) can and do cause, react, and resolve the recurring problems of cost, delay, and inconsistency in such cases. Procedural coverage will include class actions, "mass actions", federal multidistrict litigation ("MDLs"),discovery problems, judicial case management styles and strategies, and alternative dispute resolution options. Substantive legal areas include examples from mass tort, securities, environmental, employment discrimination, consumer fraud, and human rights cases.
