This course goes beyond accident law to examine defamation, invasion of privacy, fraud and deceit, and other torts that usually occur in the business setting (including consumer fraud). In addition to common law doctrines, the course will sample statutory law regarding fair business practices and consumer protection in California. The torts considered in this course often touch upon constitutional concerns (e.g., free speech, limits on punitive damages) and involve the high value litigation typical of major "corporate" law firms and consumer class action firms.
Students may meet the course requirements either by completing an in-class examination or by writing a substantial paper (30 pages). Students may meet the writing requirement, with the permission of the instructor, by preparing a more extensive (and somewhat) longer paper.
This course may satisfy the Writing Requirement.
