In recent years, the legal and popular definition of family has undergone a number of significant changes. This course will explore these changes by focusing on the way in which the American legal system has regulated the family and intimate life. The course will cover basic family law issues such as marriage, divorce, parenthood, child custody, child welfare and neglect, artificial reproductive technologies, and adoption. Students also will become familiar with the basic principles of California's community property scheme, which is frequently tested on the state bar examination. In addition to these specific topics, we will consider the role that gender, class, and race play in constructing a normative ideal of intimate life. Because families are implicated by a variety of circumstances, the course readings will feature cases that also sound in contracts, torts, constitutional law, administrative law, criminal law, immigration law, and other legal genres. Examination required.
