This seminar will meet weekly for discussion of assigned readings and lecture segments on major themes in American legal history from the colonial era to the present. Materials will consist of cases, articles from journals of history and law reviews, and several books of outstanding importance to the field. Topics will include the common law heritage in the colonies; constitutional “original intent,” federalism, race relations, the Progressive reforms and constitutional conservatism, modernization of government, the political economy inaugurated by the New Deal, the Warren Court, and “liberal legalism,” and constitutional discourse in the contemporary era.

The course is open to both JSP and JD students. A research paper is required of 2L, 3L and JSP students. An extra unit of credit optionally is available to JD students doing Writing Requirement papers.

This course may satisfy the Writing Requirement.
