This course introduces students to property law. It views property as a core legal and social institution whose definition poses fundamental questions about efficiency, fairness, wealth distribution, and the tension between public and private rights. What does it mean to own or transfer property? How does the law both protect and limit the rights of owners? How may the government permissibly regulate or take property? In grappling with these questions and others, the course will introduce students to the black-letter law as well as the larger social dynamics implicated by property law. While the course focuses primarily on substantive law, it also includes a skill-building component. Students will have the opportunity to develop and refine their exam-writing skills through practice, feedback, and structured self-assessment.
A short application is required. The application is available at https://tinyurl.com/F26Property. All students interested in sharpening their written legal analysis are welcome to apply. Applications are due April 8th.
Attendance at the first class is mandatory for all currently enrolled and waitlisted students; any currently enrolled or waitlisted students who are not present on the first day of class (without prior permission of the instructor) will be dropped. The instructor will continue to take attendance throughout the add/drop period and anyone who moves off the waitlist into the class must continue to attend or have prior permission of the instructor in order not to be dropped.
