Federal Indian Law is federal law, derived from Indian treaties, statutes and regulations, federal Indian common law, the Constitution, and the practices of the political branches. In other words, it is “Federal Law About Indians and Tribes.” Federal law poses many challenges and some opportunities for Tribal Nations. The course traces the history of federal authority and policy in Indian country and the continuation of tribal sovereignty. The course is not only theoretical and doctrinal, but also practical. The federal government, states, and tribes are independent of one another but share space and, in some ways, compete for relevance and authority. The relative place of tribes in the federal constitutional structure has never been fully theorized and results in frequent litigation. The course addresses these issues and more, across a range of subject matters.
