“Rediscovering the Video Privacy Protection Act”

In the late 1980s, a local newspaper published Robert Bork’s video rental history, and Congress responded by passing the Video Privacy Protection Act to prevent video stores from disclosing information like that about their customers.  Now, 30 years later, a new wave of lawsuits has required courts to consider how the VPPA applies to video content streamed over set-top boxes, computers, and mobile devices.  Bryan H. Heckenlively ‘09 will review those cases and put them in the context of broader issues in privacy litigation.

“TC Heartland: Is it the End of the Line for Forum Shopping in Patent Cases?”

Twenty-five years ago, the Federal Circuit decided a case that transformed where (and how) patent infringement cases can be litigated. By expanding the scope of where a corporate defendant “resides” for venue purposes, the court in VE Holding Corp. v. Johnson Gas Appliance greatly increased the number of states and courts in which many corporations can be sued for infringement. This decision has contributed to the development of forum-shopping and related litigation issues over the past several years. One company, TC Heartland, LLC, is now urging the Federal Circuit to overturn that precedent in light of statutory changes in 2011 and restore more stringent venue restrictions through a writ of mandamus, and dozens of others are joining the debate. The Federal Circuit is set to hear this case in March.
