What Drives Intellectual Property Litigation?
Remedies. Damages. Injunctions.
Why do billion-dollar patent and IP cases dominate the headlines—and the courts? What makes a company decide to sue, and what’s really at stake when an injunction can block the launch of a flagship product or when damages can reshape an entire industry?
This course pulls back the curtain on the strategies that drive intellectual property litigation: from patents that protect cutting-edge technologies to trademarks and trade secrets that safeguard brands and innovations. You’ll learn how remedies, damages, and injunctions shape litigation strategy and why they are often the true battleground in these high-stakes disputes.
Why take this course?
• If you’re fascinated by technology, this is where law meets the real-world business of innovation—smartphones, biotech, semiconductors, software, clean tech, and more.
• If you see yourself in litigation, corporate law, or IP practice, understanding why and how IP suits are filed will give you a competitive edge.
• If you’re simply curious, this class will make sense of the high-profile disputes that influence the success or failure of technology companies.
No science or technical background is required, and there are no prerequisites. The course is designed for all law students—whether you want to litigate, counsel clients, or just better understand the forces that drive today’s innovation economy.
By the end, you’ll understand not just the legal doctrines, but also the business realities and strategic considerations that make IP litigation one of the most dynamic and impactful areas of technology.

Requirements Satisfaction:

This class may be counted as either an Option 1 class (two Option 1 classes satisfy the J.D. writing requirement) or units from this class may count toward the J.D. Experiential Requirement. This class may count for both requirements if and only if a student is electing Option 1 and the student's other Option 1 class being used to satisfy the J.D. writing requirement is not being counted towards any other requirement.

Student Academic Advising and Support Services (SAASS) is available to answer questions.
