This course considers various legal devices of debt -- including security interests, mortgages, and liens -- which function to create power relationships between debtors and their creditors and between creditors. The main focus is Article 9 of the Uniform Commercial Code, but the course also covers other laws related to different kinds of property (such as fixtures) that may function as collateral for debt. Using the problem-solving method, this course focuses on practical legal skills in problem solving, statutory interpretation, and the formulation of legal strategy.
Attendance at the first class is mandatory for all currently enrolled and waitlisted students; any currently enrolled or waitlisted students who are not present on the first day of class (without prior permission of the instructor) will be dropped. The instructor will continue to take attendance throughout the add/drop period and anyone who moves off the waitlist into the class must continue to attend or have prior permission of the instructor in order not to be dropped.
