This advanced course will combine theory and practice, drawing from new academic research as well as recent litigation and events. It will explore a series of subjects, likely including the following: agency design, delegation and oversight in crisis (national security and financial regulation); agency staffing (political appointments and civil service); complex rulemaking; current agency adjudicatory practices; reviewability of agency action and inaction; preemption of state law; state administrative law; and litigation strategies related to agencies. Students must have taken Administrative Law or receive permission of the instructor.
