Writing is integral to most aspects of state and federal civil law practice including communicating effectively with attorneys, clients and judges. Advanced Legal Writing helps prepare students for the rigors of legal analysis and writing in general civil practice by providing in-depth writing experience. Using materials adapted from an actual lawsuit, students will write a trial court brief, as well as several related documents. Writing assignments will involve initial drafts, instructor feedback, peer review, and final revisions. Research skills will be reviewed and practiced. The course builds on the skills learned in the first year in Legal Research and Writing and Written and Oral Advocacy, by providing more challenging legal problems and expecting more independent work. The goal of the course will be to take students beyond basic competence to excellence in legal writing. Specifically, the course should help students hone the following skills: analyzing and conceptualizing legal issues, structuring legal arguments and documents, mastering objective v. persuasive techniques, and sharpening efficient writing and editing skills. There is no oral argument component to this course.
This course satisfies the Experiential Requirement.
