Co-host of the Strict Scrutiny podcast, law professor, and former Supreme Court clerk Leah Litman argues in her new book Lawless: How the Supreme Court Runs on Conservative Grievance, Fringe Theories, and Bad Vibes that the Supreme Court is no longer practicing law; it’s running on vibes. Major decisions adopt the language and posture of the law, while in fact displaying a commitment to protecting a political minority whose views are no longer shared by a majority of the country.
In this book talk hosted by Mass Media @ Berkeley Law and the American Constitution Society, Berkeley Law professor Amanda Tyler will discuss with Litman how to understand the present Supreme Court as grounded in and guided by everyday issues, culture, and vibes.
