James Patterson McBaine Honors Moot Court Competition

We invite the entire Berkeley Law community to join us on the evening of Monday, March 20, 2023, in Booth Auditorium at 6:00 p.m. for the final round of the McBaine Competition. We will be joined at this exciting event by the following esteemed judging panel: Judge Jacqueline Nguyen, U.S. Court of Appeals for the Ninth Circuit; Associate Justice Martin Jenkins, Supreme Court of California; Judge Kevin Newsom, U.S. Court of Appeals for the Eleventh Circuit.
The competition is modeled after United States Supreme Court practice, with 2L and 3Ls competitors representing either Petitioner appealing the lower court’s decision or Respondent opposing the appeal. This year, our competitors will take on NetChoice L.L.C. v. Ken Paxton, which asks participants to argue how the Court should review laws that restrict the ability of social media platforms to moderate user-generated content under the First Amendment and whether such laws are constitutional. The Fifth and Eleventh Circuits have split on both questions, so participants will have to reconcile divergent views on a salient and significant issue.
