CAITLIN KELLY HENRY

“Pedagogy and Ethics in the Prisoner Advocacy Network:

Launching a Community-Based, Rebellious, Collaborative,

Movement Law and Organizing Clinic”

The National Lawyers Guild’s (NLG) San Francisco chapter launched the Prisoner Advocacy Network (PAN) in response to California prison hunger strike leaders demanding individualized legal services to support movement participants. This community based clinical law teaching program trains volunteer activists and legal professionals in client-centered and transformative methods of providing legal services to people in prison. Rooted in Rebellious Lawyering, collective mobilization, and Law and Organizing theory, the model engages in mutual education with jailhouse lawyers aimed to understand and transform conditions of confinement with methods that build client power for self-advocacy and advocacy for others. This is case study in diverse methods advocating for incarcerated people, as well as ethical, logistical, and pedagogical considerations of operating a community-based clinic with a unique volunteer base of non-lawyers from several communities and schools.

“Predicting Proportionality”

The paper considers whether the kinds of machine learning algorithms that are now being used in the bail context might be able to be used in sentencing, not to predict risk, but rather to predict judgments of proportionality by judges.
