BCLT/BTLJ Law & Tech Speaker Series | Greenberg Traurig, “Why Can’t We Be FRANDs? FRAND/SEP Litigation and Prosecution”

IMPORTANT: This event will be held in person at the Bancroft Hotel, across the street from the law school. Lunch will be provided. Due to a 100 person capacity at the Bancroft Hotel, RSVP will be required for the event. You must show proof of vaccination at the entrance to the hotel. Come talk with David Bloch and Andy Schwaab, a litigator and a patent prosecutor who will look at Standard-Essential Patents and explain what they mean and why you should know about them. Standard-essential patents play an outsized role in international commerce. But SEPs are not always treated like other patents, because they are subject to an obligation to license on fair, reasonable, and non-discriminatory (FRAND) terms. SEPs also provide great insights to both sides of the patent ‘coin’, as they involve crucial aspects as to both how patents are procured and asserted. Patent prosecutors and patent litigators have very different perspectives on SEPs and FRAND obligations. This talk puts a prosecutor and a litigator together to talk about where their views align and where they differ.
