Students authored and submitted two amicus curiae briefs on behalf of Consumers Union in cases of first impression under the DMCA. In both instances, makers of consumer goods are attempting to use the law designed to protect creative content such as books, movies and music distributed on the internet from piracy as a tool to suppress competition in the aftermarket for replacement parts. The first brief was filed in the Federal District Court for the N.D. of Illinois in May 2003; the student participated in oral argument before the court in June 2003. The second brief was filed in July in the Sixth Circuit Court of Appeals. Both briefs document in the consumer harm that will result from the misuse of the statute to protect anticompetitive behavior in markets for aftermarket parts.
