Chris Hoofnagle, senior fellow to the Berkley Center for Law and Technology at the University of California-Berkeley, contends modern-data storage and data-mining technology has allowed data brokers to pervert the intent of open records law. “The government compels individuals to reveal their personal information in a variety of contexts, then pours it into the public record for anyone to use,” he says. Data brokers “collect the information, repackage it and return it back to the government and businesses full circle.”
