The Justice Department holds no power over Judge Denny Chin’s decision in the case, but he will almost certainly ask the parties to respond to the issues the department raised during the final hearing scheduled for Feb. 18, said Jason Schultz, an assistant professor of law at UC Berkeley.
“These issues are at the center of whether or not the judge will approve this deal,” said Schultz, who worked on behalf of groups that filed an objection to the settlement.
The filing could persuade Google and the plaintiffs to take another stab at revising the deal, or it could provide fodder for an appeal if the judge approves the settlement, he said.
