Sports Entertainment Law Society (SELS) Presents: Practicing Entertainment Law

Harry Rimalower and Jennifer Middleton are associates at O’Melveny & Myers’ Century City Office. In this talk they will discuss their daily lives at OMM with experience both on the transactional and litigation side of entertainment law. Harry’s practice focuses on media and technology financing, acquisitions and general corporate matters. He has represented Starz, Warner Brothers and MGM among other prominent companies in the entertainment industry. Jennifer focuses primarily on entertainment and media litigation and has litigated cases at all stages. She served as part of the team that obtained a defense verdict on behalf of AEG Live in the trial against Michael Jackson’s family in their attempt to hold AEG Live responsible for his death. The discussion will conclude with Q&A.

In October 2015, Berkeley Law and the University of Amsterdam’s Amsterdam Platform for Privacy Research (APPR) will hold the first Privacy Law Scholars Conference in Europe (PLSC-Amsterdam). PLSC is a paper workshop, with the purpose of improving the quality of privacy scholarship. PLSC has an atypical format. At PLSC, workshops are led by a “commenter” (not the author).  The commenter introduces the paper briefly and then leads a discussion of among all the participants, much like an graduate-level academic seminar. The author is present, but participates primarily by listening and considering how others interpret the work.

It has become de rigueur for consumers to receive notifications of privacy breaches. Up until very recently, the consequences of these breaches have mostly been borne by the companies involved, while the individuals affected receive a year of free credit monitoring. This year, in light of the breaches at OPM and Ashley Madison, these consequences have radically shifted: disclosure of private data has jeopardized security clearances, destroyed relationships, and led to suicides. As we further enter the "Internet of Things" era, more and more sensitive data will become stored in the cloud from an increasingly wider variety of sources. How are the consequences of data breaches likely to change in the coming years? Is the nature of what is considered "private" eroding? What, if anything, should be done about it?

Much of the debate (or hype) surrounding analytics and big data assumes that economic theory predicts data sharing is an unalloyed public good, an economic win-win for data holders and data subjects. The results from economic research on data sharing and privacy prove far more nuanced than that. Even within a purely “hardcore” economic framework more data and less privacy are not always the best, whether in terms of aggregate or individual welfare.
