This introductory course will explore fundamental legal and policy issues in environmental law. We will focus on the challenges posed by threats to the environment, as well as the strategies used to address environmental degradation, including the common law, “command-and-control” regulation, market instruments and information-gathering mechanisms. We will study many of the major federal environmental statutes “ the National Environmental Policy Act; the Clean Air Act; and the Clean Water Act “ and the controversies surrounding risk assessment, environmental federalism and enforcement.
