This course examines the law of proof, with special attention to the Federal Rules of Evidence, and coverage of the California Evidence Code where the two materially differ. Topics include relevance, hearsay, character evidence, authentication, witness competence, impeachment and rehabilitation, expert witnesses, scientific evidence, and presumptions.
Mai Linh Spencer spent five years as a trial attorney with the U.S. Department of Justice, Civil Rights Division, prosecuting federal criminal civil rights violations. After moving to the Bay Area, she represented capital and non-capital defendants on direct appeal as a Deputy State Public Defender. She spent the following three years as a Clinical Teaching Fellow and then Assistant Clinical Professor in the Civil Justice Clinic at UC Hastings, where she taught and supervised students handling employment, social security, landlord-tenant, and clean-slate cases.
