Readings in this seminar will treat major topics in American legal and constitutional history from the colonial period to nearly the present. Assignments in cases and specialized materials will be the basis for class discussion and student reports. Each student will be asked to select a topic for the research paper (eligible for the Writing Requirement) early in the semester; the paper will be due on last day of final exams. Central organizing themes will be the history and changing constitutional theories of federalism; the balance of security and liberty in wartime and in emergencies; and public rights, regulation, and private property. Enrollment is limited. Students are asked to apply (hscheiber@law.berkeley.edu) sending a short c.v., a list of courses in Law completed to date, and optionally a statement of undergraduate courses of relevance.
Prerequisites:
There are no formal prerequisites, but some prior formal study of American history will be especially useful.
This course may satisfy the Writing Requirement.
