This course examines the law of California governing the property rights of married couples and registered domestic partners. If you are not planning to practice law in California, you probably should not take this course. It includes an analysis of the principles governing classification of property as community or separate; management and control of community property; liability of marital property for debts; and division of property upon divorce or death. It also covers the rights of opposite-sex and same-sex persons who cohabit without marriage or registration. Conflict of laws issues unique to this field are covered, as is federal preemption. There will be an open book, in-class examination.
