This graduate seminar will use an interdisciplinary lens to examine how international criminal tribunals have fared in their prosecution of cases involving genocide and sexual violence since the Nuremberg and Tokyo trials. It will also examine how the legal doctrine of "joint criminal enterprise" has been applied and interpreted in cases of genocide and sexual violence. The course will use a seminar format (enrollment limit of 15) to ensure full participation in discussions. We will draw primarily on court documents, especially trial and appeals judgments, from the International Criminal Tribunal for Rwanda, International Criminal Tribunal for the former Yugoslavia, Special Court for Sierra Leone, and other international courts. We will supplement these primary documents with articles and book chapters on the history of genocide and sexual violence, including readings about investigatory and defense strategies, witnesses, and the cultural and social aspects of these crimes and how they impact victims and their communities.
