This seminar, cross-listed in the Political Science Department, draws on empirical and theoretical studies of how politics shapes and constrains law, legal institutions and legal decisionmaking.Readings view the American legal system in comparative perspective, focusing on the definition and political uses of the "rule of law"; the sources of judicial independence; how political structures and dynamics affect the design and role of courts and other legal institutions; how institutional arrangements affect legal decisionmaking; and the capacity of law and courts to engender social change. Students will be expected to produce a cholarly research paper on a course-related topic, devised in consultation with the instructor, or else to write a series of shorter papers based on the course readings and discussion.
