Complexity in litigation can arise from high stakes, large volumes of relevant information, difficult technical and scientific issues, multiple parties, or multiple forums. We will look at all these sources of complexity, the challenges they present to the legal system, and the increasingly innovative approaches that have been used to deal with them. Coverage of issues varies from year to year, but may well include: scientific evidence, electronic discovery, class actions, mass actions, arbitration of complex cases, and the law and strategy of settlement and alternative dispute resolution in multiparty, multi-forum cases. Examples are drawn from all fields of complex litigation, including intellectual property, antitrust, securities, products liability,employment discrimination and civil rights.
Prerequisites:
The only formal prerequisite for this course is civil procedure, but every litigation related course a student has taken will help.
