Our court system is struggling to address problems of access, due process, and cost-effective dispute adjudication and resolution in the recurring context of "mass tort": Claims arising from death, injury or economic loss implicating mass-produced and mass-marketed products and services. Mass Tort is where the worlds of state substantive law and federal civil procedure collide, where the economic stakes are high, where average consumers contend with multi-national corporations, and where lawyers are called upon to be warriors and peacemakers, counsellors and crusaders. This seminar will explore the challenges--and the solutions--of the mass tort phenomenon. We will use decisions and briefs from ongoing cases, and recent influential and innovative judicial decisions, as our texts.
