This course will focus on legal aspects of China’s international relations. China’s rise as an economic power and its growing international presence – symbolized by the Beijing Olympics - arouse worldwide interest and concerns. We will begin with some background on traditional Chinese conceptions of international relations and international law, and then move to the present by briefly summarizing essential aspects of China’s economic reforms and Chinese governance and society. We will then examine a cluster of trade-related topics: China’s treatment of foreign direct investment, including institutions and practice related to Sino-foreign commercial disputes; China’s adherence to the obligations it assumed when it joined the WTO; and Chinese companies’ investments in other nations. We will then consider China’s approaches to international law and Chinese behavior in the UN; China’s policies and practice related to human rights; China’s participation in multilateral arrangements such as treaties on nonproliferation of weapons of mass destruction and in multilateral organizations such as ASEAN; and, finally, China’s policies and practice on environmental problems both within and beyond its borders.

As indicated below, students may choose to take a take-home exam or write a term paper. A small number of students may be permitted to write a paper intended to satisfy the writing requirement.
