This course will cover the beginning stages of patent litigation, including the filing of the complaint and answer, document discovery, depositions, and the claim construction (Markman) hearing.

Students will learn primarily through team participation in mock litigation that uses materials taken from actual, recently filed patent infringement actions. In the first half of the course, students will draft complaints and answers, discovery requests and responses, and take and defend depositions. In the last half of the course, students will submit claim construction briefs and present oral arguments at a claim construction hearing in front of practicing patent litigators.

Local patent litigators will also provide guest lectures for several of the course sessions.

There will be no final exam. Grading will be based on mock pleadings, depositions, and oral argument.

Prerequisites:
Introduction to IP I; Patent Law; or equivalent (which includes summer work in patent law).
