Prerequisite: Patent Law or equivalent.
This course will be a hands-on introduction to patent litigation. The class will be taught around a hypothetical patent litigation, in which doctrinal elements of patent law, such as infringement, validity and damages will be explored, not only through discussions of relevant Federal Circuit and Supreme Court decisions, but also through student argument on behalf of the hypothetical plaintiff’s and defendant’s positions.
There will be no final exam, but short briefs will be required for several classes.
Course Materials: (1) materials, including a patent-in-suit, specifications of an accused product, prior art, witness biographies and summaries of testimony, and selected technical and business information relating to and describing a hypothetical patent action between two high-tech companies; (2) Cases relating to the legal issues discussed in each week’s class.
