California is at the heart of the video game industry in the United States, which is now larger than the film industry. This seminar examines the legal regulation of the video game industry in sequence from the development to the distribution of game assets. Doctrines will be discussed as applicable from the perspective of in-house counsel addressing the issues of clients, customers, and competitors. An underlying concern is to assess the role of the law, especially the intellectual property regime, in fostering and/or inhibiting creativity and innovation within a particular industry.

The seminar will be based on discussion using a range of materials and exercises, including discussing case-law, law review and popular press articles, reviewing a range of industry contracts, advising guest industry experts, conducting infringement analyses, and participating in a negotiation exercise between a developer and publisher. The class will conclude with students presenting on topics of their choosing in order to receive feedback prior to completion of the final paper.
