Prerequisite: Patent Law or Intro to IP.

This course will be a hands-on introduction to patent litigation. The class will be taught around a hypothetical patent litigation, in which doctrinal elements of patent law such as infringement, validity and damages will be explored, not only through discussions of relevant Federal Circuit and Supreme Court decisions, but also through student argument on behalf of the hypothetical plaintiff’s and defendant’s positions. There will be no final exam, but short briefs will be required for several classes.

Course Materials: (1) Materials, including a patent-in-suit, specifications of an accused product, prior art, witness biographies and summaries of testimony, and selected technical and business information relating to and describing a hypothetical patent action between two high-tech companies; (2) Cases relating to the legal issues discussed in each week’s class.

Instructor Biography: Matt Powers is the head of Weil, gotshal & Manges' Patent Litigation Group and specializes in trying patent and trade secret cases. He has litigated and tried cases all over the world involving a wide range of technologies, including semiconductor devices and manufacturing equipment and processes, DNZ sequencing, medical devices and other biotechnologies, computer hardware and software, communications (network and telephony) and the Internet.
