This course explores the law relating to the protection of software, databases and computers. The primary focus will be on three areas of law: intellectual property, contracts and licensing, and antitrust law. We will also cover international and commercial issues as well as current hot topics, such as Open Source Licensing and the Digital Millennium Copyright Act. Prior courses in intellectual property topics are recommended but not required; there will be no or minimal overlap with other courses. No technical background is required; a hands-on introduction to information technology will be provided as part of the course.

The course will have a final exam. Students can satisfy Writing Requirement.

INSTRUCTOR: Lothar Determann studied German, English and French law at the University of Passau in Bavaria and passed First State Exam (JD-equivalent) 1994; taught law at Free University of Berlin Law School (since 1994); obtained doctorate law degree 1996 (Dr. iur - JSD equivalent); clerked for Berlin Court of Appeals (1995-97); Second State Exam 1997; post-doctorate thesis on Internet law (Habilitation) and admittance to Association of German Public Law Professors (1999).

Since 2000, Lothar Determann is admitted to the California Bar and holds lectures on IT Law, E-Commerce Law and Data Privacy Law as Visiting Professor at University of San Francisco Law School. He also holds a yearly seminar on Electronic Business Law at Free University of Berlin. He frequently gives presentations on international and intellectual property law topics for the American Conference Institute and the Practicing Law Institute.
