This highly interactive course will help students succeed in their professional and personal negotiations. The course will explore a series of theoretical frameworks, and through group discussions and role plays, students will gain skills in applying the theory to real-life negotiations. Students will learn how to prepare for, conduct, and review negotiations systematically. Class exercises will cover preparation, creating and claiming value, creative problem solving, client counseling, difficult tactics, ethical issues, listening and communication skills. The intensive nature of this class provides students with an opportunity to learn and integrate valuable interpersonal skills, evaluate and improve their own skills, work closely with one another, and receive feedback from the professor and colleagues.
Attendance and participation at all scheduled classes is mandatory. Please note that there will be a mandatory Saturday class in November (TBD) during which the students will conduct a team negotiation across the table from students from another law school or another negotiation class at Boalt. This team negotiation is a culmination of the learnings throughout the semester and a significant portion of the overall grade. If students are unable to attend the Saturday class, it is recommended that the student enrolls in another section of Negotiations that does not have the mandatory Saturday class.
Due to the use of simulation exercises throughout the semester and the need to determine members of the class as soon as possible, the usual provisions of "Add/Drop" do not apply. All interested students, whether enrolled or on the wait list, should attend the first session at which time enrollment will be confirmed. Simao Avila has practiced labor and employment law for over 25 years. He is Senior Counsel for Kaiser Permanente, member of the Labor and Employment law group, in the Office of General Counsel, where he provide legal counseling and representation covering the full spectrum of employment cycle from hiring to termination. Among various duties, he is liaison labor and employment counsel for the Northwest and Colorado Regions.
Prior to his current position, he was University Counsel, University of California, Office General Counsel. There he practiced generally all areas of employment and labor law in the service of the University’s ten campuses, five medical centers and two national laboratories. Among other duties, he represented the University in many administrative hearings, fact-findings, arbitrations and mediations. In addition to his regular duties, he presented on various subjects at NACUA’s annual conferences and spoke regularly at internal conferences on pertinent labor and employment issues dealing with the complexities of today’s diverse work force. He co-author of A Litigator’s Guide to Effective Use of ADR in California published by Continuing Education of the Bar (CEB)
