As the country debates the ways to stimulate the economy, rebuilding our infrastructure and promoting new construction are in the forefront. This course focuses on the role attorneys play in drafting the contracts for a construction project and in representing clients in the inevitable disputes that arise during construction. The course is a participatory seminar designed to cover the entire construction process from retention of the design team through correction of defects in the completed project. The course looks at the construction process from both the contractual perspective and the litigation issues that commonly arise in delayed or defective construction. We cover the relationships between the parties involved in the design and construction process; the various methods used to organize projects; the key provisions to be included in construction and design contracts, the allocation of responsibilities for the timely completion of the project in accordance with the design intent, the obligations and protections for subcontractors and suppliers and the means of resolving disputes between the parties involved in the process. We examine statutes and standard contracts to see how they deal with these issues. We include a site visit to see the application of these concepts.
