SECTION 2B-622. RETRACTION OF ANTICIPATORY REPUDIATION.

(a) Until the repudiating party's next performance is due it can retract its repudiation unless the aggrieved party has since the repudiation canceled or materially changed its position in reliance on the repudiation or otherwise indicated that it considers the repudiation final.

(b) Retraction may be by any method which clearly indicates to the aggrieved party that the repudiating party intends to perform, but must include any assurance justifiably demanded under Section 2B-620.

(c) Retraction reinstates the repudiating party's rights under the contract with due excuse and allowance to an aggrieved party for any delay occasioned by the repudiation.

Committee Action: This section was considered without substantial substantive comment.
