Nebraska Legislative Bill 36

 

Nebraska Legislative Bill 36 (LB36) was introduced on January 8, 3008 by Sen. Mike Flood of Norfolk. If approved, LB36 will make lethal injection the state's sole method of execution and authorize the Nebraska Department of Corrections to develop an execution protocol. Nebraska has been without a method of execution since the State Supreme Court ruled that electrocution violated the state constitutional ban on cruel and unusual punishment in February 2008. Governor Dave Heineman and State Attorney General Jon Bruning both support the bill. Sen. Brenda Council of Omaha has announced her intention to introduce a bill that would repeal the death penalty in Nebraska. In 2007, a similar bill introduced by termed-out Senator Ernie Chambers, Council's predecessor, failed to pass in the legislature by one vote.
